President’s Export Council Subcommittee on Export Administration

 

The President’s Export Council Subcommittee on Export Administration (PECSEA) is a subcommittee of the President’s Export Council (PEC) that effectively serves as an advisory committee on export controls to the Secretary of Commerce or the Secretary’s designee. PECSEA draws on the experiences and perspectives of its members to provide advice and make recommendations on protecting U.S. national security and foreign policy concerns through the administration of export controls without unduly harming U.S. technology leadership and commercial trade, while also strengthening the U.S. defense industrial base.

PECSEA will be composed of members selected from industry and other non-governmental organizations who are exporters of or otherwise engaged in activities related to items that are presently controlled under the Export Administration Regulations (EAR) or are proposed for such control, balanced to the extent possible among large and small firms.

The PECSEA is seeking private-sector members who are preferably senior executives within their companies with significant operational control around production, supply chains, research and development activities, and/or international sales and have an understanding of the impact of export controls on these functions and the broader marketplace.

Meetings Pursuant to the Federal Advisory Committee Act, as amended (FACA) (5 U.S.C. § 1001 et seq.), PECSEA meetings and meeting agendas will be announced in the Federal Register, typically all or a portion will be open to the public, minutes of the public portion of meetings will be made publicly available, and its recommendations and reports will be public. Frequently Asked Questions on the PECSEA Nomination Requirement and Process

 

When are nominations for PECSEA membership due?

  • Nominations for PECSEA membership are due February 8, 2024, at 5 pm Eastern Standard Time. After that date, the Department may continue to accept nominations for up to approximately two years to fill any vacancies that may arise. More information is available at the Federal Register notice announcing the call for nominations.

What is required for a nomination submission?

  • The Federal Register notice announcing the call for nominations contains all necessary details and instructions to apply for membership.
  • Self and third-party nominations are permitted. Third-party nominations should state that the candidate agrees to the nomination.
  • PECSEA is seeking members from industry and other non-governmental organizations who are exporters of or otherwise engaged in activities related to items that are presently controlled under the EAR or are proposed for such control, balanced to the extent possible among large and small firms. Members are preferably senior executives within their companies with significant operational control around production, supply chains, research and development activities, and/or international sales and should have an understanding of the impact of export controls on these functions and the broader marketplace. Members must also be eligible for a secret level clearance.

  • Pursuant to the Federal Register notice, nominations should be submitted in MS Word or pdf format.

Who may submit a nomination?

  • There are no formal restrictions or requirements on who may submit a nomination. Nominations, be they self-nominations or from a third party, should contain all necessary details to apply for membership, as detailed in the Federal Register notice. Selections will be based on experience and ability to help PECSEA fulfill its mission. (See question on requirements for nominations.)

May I nominate myself?

  • Yes, self-nominations may be submitted.

How many members will be on PECSEA?

  • PECSEA will consist of approximately 25 members.

When will PECSEA begin its work?

  • PECSEA will begin its work soon after its members are appointed.

Who selects PECSEA members from nominees?

  • Members other than the Chair are appointed by the Secretary of Commerce.
  • The PECSEA Chair is the Honorable Lisa Disbrow, who currently serves on the PEC, and was designated by the PEC Chair, with the concurrence of the Secretary of Commerce per the PEC Charter.
