Compliance with the Export Administration Regulations (EAR) in Automated Export System (AES) Electronic Export Information (EEI) Filing

The Bureau of Industry and Security (BIS) encourages exporting companies to participate in Census Bureau AES Compliance Seminar training to understand the requirements for complying with the EAR in AES’s EEI filing. Attending AES seminars is an invaluable way for a company to contribute to U.S. national security and nonproliferation priorities while protecting vital company interests by minimizing the risk of AES filing noncompliance with the Foreign Trade Regulations (FTR) and the EAR.

The Office of Technology Evaluation (OTE) presents at AES training seminars on the requirements for reporting in AES items that are controlled for export under the EAR. In order for companies to report EAR required information they need to determine if the items are subject to EAR controls. Among the check list of questions are:

  • What is the company exporting? (including determining the Export Control Classification Number),
  • Where is the item destined?
  • Who are the parties to the transaction?
  • How will the item be used?

AES is used by many U.S. government agencies to measure the compliance of U.S. exports with U.S export control laws. AES seminars cover mandatory filing requirements, filing timeframes, types of export transactions (Standard and Routed), how to avoid penalties and cargo seizure, common FTR violations, mitigation guidelines, export enforcement, commodity classification (Schedule B codes), and using current trade statistics to discover new markets.
