BIS Releases Export Compliance Guidelines in Spanish

The Bureau of Industry and Security (BIS) is pleased to introduce two Spanish-language guidance documents, Elementos de un ECP (Elements of an ECP) and Directrices de Cumplimiento Para Las Exportaciones (Export Compliance Guidelines). The English and Spanish language versions of Elements of an ECP are posted on BIS’s website here and here ; the two versions of the Export Compliance Guidelines are here, in English, and here, in Spanish.

The documents, both of which focus on the elements that BIS recommends as part of a comprehensive export compliance program, are among the resources and services that BIS makes available to the exporting public to assist with compliance with the Export Administration Regulations (15 CFR, 730 – 774) (EAR). BIS is releasing the two documents as part of its commitment to the implementation of executive Order 13985 of January 20, 2021, Advancing Racial Equity and Support for Underserved Communities Through the Federal Government. BIS chose to offer the documents in Spanish based on data from the Department of Commerce’s Census Bureau and Minority Business Development Agency indicating that after English, Spanish is the language most frequently spoken in the United States, and, that while a disproportionately small number of minority business enterprises are exporters, these businesses benefit more from exporting as compared to nonminority-owned firms.

BIS’s partnership with exporters is essential to the success of its mission to “advance U.S. national security, foreign policy, and economic objectives by ensuring an effective export control and treaty compliance system and promoting continued U.S. strategic technology leadership.” With the release of these two guidance documents in Spanish, BIS hopes to encourage more minority business enterprises to export their products.

La Oficina de Industria y Seguridad (BIS) publica las pautas de cumplimiento de exportaciones en español

La Oficina de Industria y Seguridad (BIS) se complace en presentar dos documentos de orientación en español, Elementos de un ECP (Elementos de un ECP) y Directrices de Cumplimiento Para Las Exportaciones (Normas de Cumplimiento de Exportaciones). Las versiones en inglés y español de Elementos de un ECP se publican en el sitio web de BIS aqui y aqui; las dos versiones de las Directrices de cumplimiento de exportaciones están aqui y aquí.

Los documentos, cuales se enfocan en los elementos que recomienda BIS como parte de un programa integral de cumplimiento de exportaciones, se encuentran entre los recursos y servicios que BIS pone a disposición del público exportador para ayudar con el cumplimiento de las Regulaciones de Administración de Exportaciones (15 CFR, 730). - 774) (EAR). Symposium sessions will run from 8:30am to 5:00pm on both days. Each day will conclude with an informal networking session in the Hotel Monaco.  The registration fee is $405.00 per person and advance registration is required.

The instructors are experienced export compliance specialists from BIS' Washington, D.C. headquarters. In addition, representatives from the Bureau of the Census, Department of Treasury Foreign Assets Control Office, Office of Export Enforcement, Department of State, Directorate of Defense Trade Controls and Department of Homeland Security, Customs and Border Protection have been invited to present.

The instructors will be available throughout the seminar to answer your questions on how U.S. export control requirements and regulations affect the export activities of your organization or client.

No Cookie Cutter Approach
Like fingerprints on a person, ECPs are unique to each company.  More importantly, an effective ECP requires a high-level of detail with easy to read instructions. Lofty and vague policy statements should be strictly limited in an ECP. Look to build, educate, and enhance whenever possible.

Review our comprehensive guide to the eight elements, "Export Compliance Guidelines: The Elements of an Effective Export Compliance Program." This extensive book offers an in-depth explanation on the eight elements and how they relate to the requirements set in the Export Administration Regulations. Scattered throughout the book are examples, templates, charts, figures, and illustrations to assist you in drafting your own Export Compliance Manual.

Within the manual is the "Audit Module: Self-Assessment Tool." a checklist to compare your procedures against the Compliance Guidelines ECP.
