BIS Export Control Officers (ECOs) play a unique and critical role in monitoring the compliance of transactions subject to BIS’s Export Administration Regulations (EAR) (15 CFR parts 730-774) outside the United States to prevent and detect illicit diversion to unauthorized end uses, end users, or destinations. ECOs are BIS Special Agents who swear into the Department of Commerce’s Foreign Commercial Service under limited appointments. These overseas BIS representatives leverage their law enforcement, commercial and diplomatic skills to expand the U.S. government’s export compliance capabilities beyond its borders and into key overseas trade centers.

BIS currently has nine ECO positions overseas: at the U.S. Embassies in Beijing, China (two officers); New Delhi, India; and Singapore; and at the U.S. Consulates in Hong Kong, China; Frankfurt, Germany (two officers); Dubai, United Arab Emirates, and Istanbul, Turkey. ECOs are placed in strategic trade locations abroad so they may consistently and safely conduct End-Use Checks (EUCs), consistent with the Export Control Reform Act of 2018 (50 U.S.C. 4820(a)(7)) and § 734.11 of the EAR. There are two types of EUCs: EUCs which are proactively targeted and conducted to check the bona fides of companies receiving items subject to the EAR before the Department of Commerce takes final action on a license application are called Pre-License Checks (PLC); EUCs which are conducted to confirm the lawful receipt and use of items subject to the EAR following the issuance of a license or export, reexport, or transfer (in-country) under a license exception or “no license required” are called Post-Shipment Verifications (PSV).

ECOs advance national security through outreach to foreign business communities, liaison with foreign government counterparts, and support to broader U.S. Government activities in their regions. The ECO can answer direct inquiries from industry and government representatives on export control issues pertinent to the region in which they are assigned.
