This reference table should not, however, be relied upon as the only source for determining whether an export license is required for a particular transaction. To make that determination, it is necessary to follow the steps outlined in Part 732 of the Export Administration Regulations (EAR), including consulting the actual entry on the Commerce Control List to determine which column of a particular control applies (e.g. NS1, NS2, NP1, NP2), reviewing the country chart (Part 738), consulting Part 746 (Embargoes and Other Special Controls), determining whether the proposed transaction involves a denied person, and reviewing the end use in light of the requirements of Part 744.
The left column of the table identifies the item. The next four columns identify the Commerce Control List entries affecting those items. The headings of these columns identify the relevant multilateral control regimes, such as the Wassenaar Arrangement (WA), the Nuclear Suppliers Group (NSG) and the Missile Technology Control Regime (MTCR) and the applicable reasons for control, such as National Security (NS), Nuclear Nonproliferation (NP), Missile Technology (MT) and Anti-Terrorism (AT).
BXA has worked with its Materials Processing Equipment Technical Advisory Committee to make this table as useful as possible. We have tried to cover most of the most common types of general purpose machine tools and material processing equipment that appear on the Commerce Control List using terminology that we believe will be readily understandable to people in the affected industry. This table does not, however, provide a comprehensive list of such items or incorporate all of the names under which a particular item may be known. Nothing in this chart should be read as changing or interpreting the requirements of the EAR. Each exporter is responsible for complying with all provisions and requirements contained in the EAR.
